Traumatic Brain Injury in Florida: Who Can You Sue?

Almost always, traumatic brain injuries are irreversible. In Florida, injury victims brought on by the fault or negligence of another person or company are entitled to seek restitution for their damages and any additional losses they may have incurred due to the injury.

What is a Traumatic Brain Injury (TBI)?

traumatic brain injury

Traumatic brain injuries are typically brought on by a violent blow to the head, neck, or spine. The soft tissue will be bruised due to the brain colliding with the inner skull walls. It may happen in more complicated situations when the skull and brain tissue are penetrated.

Every year, statistics on traumatic brain injuries and other accidents are released by the Centers for Disease Control and Prevention. Traumatic brain injuries are thought to affect 1,7 million people annually. Sadly, this number leads to over 50,000 fatalities and 275,000 hospital admissions.

Each traumatic brain injury is unique and has a different degree of severity. A concussion, which results in headaches, dizziness, and confusion, is the most common type of TBI. Memory loss and exhaustion are possible side effects of severe concussions.

In severe cases, traumatic brain injury can result in permanent mental and physical problems. The victim may find it challenging to continue living their previous life. These more severe side effects include loss of motor control, coma, and vegetative states. In the worst case, the victim might never awaken or regain consciousness.

Who to Sue for TBI

Slip and Fall

People who fall and strike their heads against the ground or another object, particularly if they hit the back of their heads, may suffer brain damage.

Injuries sustained by visitors due to a fall brought on by a hazard on the property may subject the owner to liability. Any potentially hazardous circumstance, such as poor lighting or a lack of pool fences, is a hazard.

Falling From Heights

Falls from great heights typically result in fatal TBIs, leaving loved ones to deal with the consequences of someone else’s negligence.

Due to the frequency of these occurrences, construction sites are yet another hazardous workplace. Unfortunately, many construction companies do not ensure their employees’ safety when working at heights.

Vehicle Accidents

Due to the force of a collision, concussions and other types of TBI are frequently experienced by drivers and passengers. During a crash, the body may move violently and quickly, which could cause the brain to move inside the skull and sustain injury.

Drivers and passengers hurt in auto accidents typically have the right to pursue financial compensation. Driver error, such as speeding or distracted driving, is to blame for most car accidents. However, compensation claims may be supported by evidence of vehicle flaws, traffic issues, poor maintenance, and other elements.

Workplace Accidents

Although the employer must give workers a secure workplace and the necessary safety gear, this isn’t always the case. Accidents at work may result in a mild or severe TBI.

Boating Accidents

Those who engage in recreational boating and those who work in the marine industry are especially susceptible to traumatic brain injury. In the event of a ship collision, financial compensation is typically sought by filing a claim with the operator’s insurance provider.
